These terms and conditions apply every time you access or use www.campingninja.com (the “Website”) so please read them carefully.
By accessing, registering or using our Website, you confirm that you have read and agree to be bound by these terms and conditions. We may vary these terms and conditions at any time and such modifications will become effective immediately upon posting of the modified terms on the Website. By continuing to use the Website following any such variation, you will be deemed to have accepted such variation.
In these terms and conditions, any reference to "we" "us", "our" or "Camping Ninja" refers to Camping Ninja Limited (registered company number 07042030) and any reference to "you" or "your" refers to you, the user of the Website (including any person who we reasonably believe is acting with your authority or knowledge). References to “Campsite(s)” means a campsite and/or other services/facilities listed on the Website.

Our Role
We are a booking engine and intermediary for Campsites and act as agent only in respect of all bookings made through the Website.
All information on the Website relating to a Campsite including, without limitation, prices, availability, location, facilities or accreditations/ratings (other than customer reviews or ratings) has been submitted by the Campsite provider. Such Campsite providers are independent businesses and are not employees or agents of Camping Ninja.
Inclusion of a Campsite on the Website does not constitute a recommendation of it by Camping Ninja. You accept that we have not undertaken any quality or other checks of the Campsites included on the Website.
We ask Campsites to submit accurate information to the Website however we do not warrant that the information is accurate and/or error free. When you use the Website you acknowledge that the information may be inaccurate.
We will not be liable for any loss or damage incurred as a result of your access to/use of information provided by third parties, including without limitation Campsite providers. You are solely responsible for evaluating the accuracy or completeness of any information accessed via the Website.
When you make a booking, your contract for the pitch or other facilities/services will be with the relevant Campsite provider. We are not a party to that contract and have no liability whatsoever to you in respect of it, including if the facilities provided do not meet your needs or for the acts or omissions of any Campsite provider, other service provider and/or third party.
The Campsite’s terms and conditions will apply to your booking – these may exclude or limit the Campsite provider’s liability to you so it is important that you read them carefully.
You accept that we have not in any way selected or assembled your travel arrangements for you. Your accommodation arrangements are not a package and do not fall within the meaning of the Package Travel, Package Holidays and Package Tour Regulations 1992 nor the Civil Aviation (Air Travel Organisers’ Licensing) Regulations 1995.
Liability
In the event that Camping Ninja has any liability to you in contract, tort (including negligence) or otherwise in relation to your use of the Website or otherwise, it is limited to the amount of the deposit paid to us only.
We exclude all liability of any kind in respect of any failure to do what we have promised because of something beyond our reasonable control such as technical failure, lightning, flood, exceptionally severe weather, fire or explosion, civil disorder, war, military operations, industrial disputes of any kind (including those involving our employees), natural or local emergency, anything done by government or other competent authority.
We do not accept liability either in contract, tort (including negligence) or otherwise, for direct or indirect loss of profits, income, business or anticipated savings, nor for any indirect, incidental or consequential damages, including, without limitation, loss or destruction of data, or other information.
Nothing in these terms and conditions shall operate to exclude or limit the liability of Camping Ninja for death or personal injury caused by our negligence, for fraudulent misrepresentation or for any other liability which cannot legally be excluded or limited.
Each provision of these terms and conditions excluding or limiting liability operates separately. If any part is held by a court to be unreasonable or inapplicable, the other parts shall continue to apply.
Charges and Payment
When you make a booking through the Website you agree to pay a deposit to us. Save as expressly stated in these terms and conditions, this deposit is non-refundable and non-transferable.
The balance of the cost of the [pitch and any other facilities/services] together with any applicable taxes will be payable direct to the Campsite at the time of your stay.
Making and changing a booking
Where the Campsite Owner’s Information is showing availability and you make a booking and pay a deposit, Camping Ninja will send you a confirmation email setting out the details of your booking. If you do not receive a confirmation email within 24 hours of paying the deposit, please contact Camping Ninja.
If the Campsite Owner subsequently informs Camping Ninja that there has been an error and, in fact, the relevant accommodation, facility or service is not availability, Camping Ninja will contact you and refund the deposit paid.
After the deposit has been paid, the Campsite provider’s cancellation policy will apply. Please remember that the deposit paid to us is non-refundable and non-transferable save as stated above or as we may determine from time to time in our sole discretion.
Use of your information
Please look at our Privacy Policy (www.campingninja.com/privacy), which sets out how we may use information provided by or collected from you when accessing or using the Website to ensure you understand our practices.
Your responsibilities
Passports/visas – you are responsible for ensuring you hold all appropriate passports and visas. We recommend that you check the latest advice on your destination country on the British Foreign and Commonwealth Office website before you travel (www.fco.gov.uk/en/travel-and-living-abroad/travel-advice-by-country)
Insurance and health – we recommend that you have appropriate and adequate travel insurance and health documentation in place at the time of booking and take the necessary documentation with you.
Special requests – please notify the Campsite provider direct of any special requirements. We cannot guarantee that such requests can be met and have no liability to you in respect of them.
Appropriate behaviour – you are solely responsible for any loss or damage caused by you or a member of your party. In the event that a Campsite provider or other supplier brings any claim against us or otherwise seeks to recover any loss or damage resulting from your actions from us, you will be responsible for meeting such claims.
If you or any member(s) of your party are in breach of any of these terms and conditions, infringe the rights of any third parties or contravene any applicable law or regulation we reserve the right to cancel your booking without refund or compensation. We shall not be liable for any loss, damage or expense resulting from your incorrect, incomplete or missing documentation or not compliance with official requirements.
Your use of the Website
We may suspend or restrict access to the whole or any part of the Website for operational reasons at any time.
We reserve the right to monitor your use of the Website in order to maintain the Website and to protect the rights of content owners and other users of the Website
You must not use the Website or any information contained on it:
for unlawful or fraudulent purposes, or in connection with a criminal offence or other unlawful activity;
to send, receive, upload, download, use or reuse any material that is illegal, offensive, abusive, malicious, threatening, racist, indecent, defamatory, derogatory, obscene, menacing, or otherwise objectionable;
to harass, stalk, inconvenience, cause annoyance or needless anxiety to any person, impersonate any other person or act in a way which may reasonably be objectionable or is otherwise injurious to third parties;
in any way that breaches copyright, trademark, confidence, privacy or infringes the intellectual property rights of Camping Ninja or others;
other than for your own private and personal use and not for any commercial purposes or to send commercial advertising or promotional material;
in any way that causes, or is likely to cause, the Website or access to the Website to be interrupted, damaged or impaired in any way; and/or
in any way that impacts other users' use and enjoyment of the Website or services made available through it.

Where you create, upload or publish any content (including without limitation any user review or rating) on the Website, you are responsible for the creation, maintenance and design of all such material. In particular, you warrant that:

the information in your possession and provided by you will not constitute a criminal offence or be otherwise unlawful;
all necessary licences and consents (including those from owners of copyrights or performing rights) have been obtained to upload or publish the materials on the Website.
You accept that we are under no obligation to edit, review or modify any content provided by you or any third party and that we do not examine the use to which the Website is put, unless expressly stated otherwise. However, we reserve the right to remove any content, in whole or in part, at our sole discretion if we believe that there may be a breach of these terms and conditions or if the content does not comply with our notified requirements.
We do not claim ownership of any content you submit or make available via the Website. However, by submitting or making available any content on the Website (including any text, photographs, graphics, video or audio) you agree to grant us a perpetual, royalty-free, irrevocable, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your material worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution as we may require. We will not identify you personally as the creator of the content unless you provide your express consent. If you do not want to grant us the rights set out above, please do not submit content to the Website.
Intellectual property rights in all services, content, software and documentation supplied by us remain our property or that of our licensors and we expressly reserve all rights not expressly granted by us.
The word or mark "Camping Ninja" however represented, including stylised representations, all associated logos and symbols, and combinations of any of the foregoing with another word or mark, are our trademarks. You shall not make any use of the trademarks except as permitted by these terms and conditions.

Please contact the Campsite owner or other relevant supplier direct if you have any complaints regarding the accommodation or facilities/services booked through the Website.

General
If we delay in acting upon a breach of these terms and conditions by you, that delay will not be regarded as a waiver of the breach. If we do waive a breach of these terms and conditions by you, that waiver is limited to the particular breach.
If any provision of these terms and conditions is found to be illegal or unenforceable the remainder of these terms and conditions will not be affected and the provision in question will be deemed modified to the extent necessary to make it enforceable.
The contract created by your acceptance of these terms and conditions is governed by English law and you and we submit to the non-exclusive jurisdiction of the English courts.
